Welcome to Budge! These Terms of Service (“Terms”) govern your use of our mobile application and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

5. Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
5. User Content
You may be able to post, upload, or otherwise contribute content to the Service, including comments, reviews, and other materials (“User Content”). You retain all rights in, and are solely responsible for, the User Content you post.
By posting User Content, you grant Budge a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, distribute, display, and perform your User Content in connection with the Service.
You agree not to post User Content that:
1. Is false, misleading, or deceptive.
2. Is defamatory, obscene, pornographic, vulgar, or offensive.
3. Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
4. Is violent or threatening or promotes violence or actions that are threatening to any person or entity.
5. Promotes illegal or harmful activities or substances.
6. Intellectual Property Rights
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Budge, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:
1. Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials.
2. You may store files that are automatically cached by your Web browser for display enhancement purposes.
3. You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
7. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with these Terms of Service. You agree not to use the Service:

5. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm Budge or users of the Service or expose them to liability.
8. Monitoring and Enforcement; Termination
We have the right to:
1. Remove or refuse to post any User Content for any or no reason in our sole discretion.
2. Take any action with respect to any User Content that we deem necessary or appropriate in our sole discretion.
3. Terminate or suspend your access to all or part of the Service for any or no reason, including without limitation, any violation of these Terms of Service.
9. Changes to the Service
We may update the content on this Service from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Service may be out of date at any given time, and we are under no obligation to update such material.
10. Information About You and Your Visits to the Service
All information we collect on this Service is subject to our Privacy Policy. By using the Service, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
11. Geographic Restrictions
The owner of the Service is based in India. We make no claims that the Service or any of its content is accessible or appropriate outside of India. Access to the Service may not be legal by certain persons or in certain countries.
12. Disclaimer of Warranties
Your use of the Service is at your own risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied. Neither Budge nor any person associated with Budge makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Service.
13. Limitation on Liability
In no event will Budge, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service, any websites linked to it, any content on the Service or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages.
14. Indemnification
You agree to defend, indemnify, and hold harmless Budge, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of the Service.
15. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of, or related to, them, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of MH/IND without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Service shall be instituted exclusively in the federal courts of MH/IND or the courts of the State of MH/IND.
16. Waiver and Severability
No waiver by Budge of any term or condition set out in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Budge to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.
17. Entire Agreement
The Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and Budge regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

By using Budge, you acknowledge that you have read these Terms of Service, understood them, and agree to be bound by them. If you do not agree to these Terms of Service, you are not authorized to use the Service. We reserve the right to change these Terms of Service at any time, so please review them frequently.
